Welcome to MzansiGo (PTY) LTD (Company Registration K2016/x514145 – South Africa hereafter referred to as MzansiGo) — the platform. ("MzansiGo," "we," "us," or "our") that connects you with a Hyundai H100 or Kia K2700 truck and two helpers who will move, dispose or donate your stuff for you.

These Terms of Service ("Terms") apply to your access and use of the "Request a Mover" platform, website ("Site") and other online products and services (collectively, the "MzansiGo Platform") of MzansiGo.

Accepting these Terms



BY ACCESSING OR USING THE MZANSIGO PLATFORM, YOU AGREE TO BE BOUND BY ALL OF THE TERMS BELOW. Please read all of the terms before you use the MzansiGo Platform. If a term does not make sense to you, please let us know. If you don't agree to all of the terms below, you may not use the MzansiGo Platform.

Description of the MzansiGo Platform



Through the MzansiGo "Request a Mover" platform, you can submit a request (a "Request") for a Hyundai H100 and Kia K2700 truck and two helpers to pick up the item(s) you specify (each, an "Item") for loading, unloading, moving, hauling, packing, lifting, (the "Services"). You will receive price quote for the fee that will apply to completing your Request (the "Services Fee"). Once you submit the payment information for the Request, your Request will be sent out to one of the drivers in our network of Hyundai H100 and Kia K2700 trucks. You will receive a notification via Text Message indicating that your request has been lodged with a follow up message with the drivers contact details, truck registration details and expected time of arrival. You will be able to communicate with that Driver via SMS or phone calls to coordinate certain logistics involved with completing your Request.

You represent and warrant that the Items related to any Request are your personal property and you have all right, title and permission to request and allow the loading, unloading, moving, packing, or lifting of any Items, and that the performance of the Services by a one of the Movers will not result in the violation of any third party's ownership or privacy rights.

General Pricing Terms



Any fees that We may charge you for the Software or Service, are due immediately. We have the sole right to determine and charge the prevailing prices for the Service, which may not be the same as those reflected from time to time on Our website. Any updates or changes to your move may change the fees owed, and you agree that We have the right to collect from you any fees associated with changes to your move, including a reasonable cancellation fee if necessary.

Any amount that is not paid when due will accrue interest at an annual interest rate of eighteen percent or the maximum rate permitted by applicable law, whichever is less, from the due date until paid. You agree to pay for all amounts incurred by Us in our effort to collect any unpaid fees from you, including costs and expenses of a third party collection agency. We may engage third party collection agencies to assist with collecting amounts owed that are unpaid at least 30 days beyond the due date

Pricing is solely dependent on the pick-up and delivery location. It is thus the responsibility of the user to ensure that the specified inventory list will fit into the following specified cargo area as per the Hyundai H100 and Kia K2700 truck cargo area dimensions:

- Length = 2.8m
- Width = 1.6m
- Height= 3.5m

The total weight of the items is not to exceed 1.5 Tons. MzansiGo will make every effort to load all items in one move. If it is found that all items do not fit in one load, the user will have to request another trip via the MzansiGo Platform.

Payment for Services



You must provide credit card information to submit a Request. You are responsible for paying the applicable Services Fee for any completed Services. Once you submit a Request, we will charge your account with the amount agreed upon.

EFT Payments are also accepted if payments are made 72 hours before the move is scheduled. Proof of payments must be sent through to admin@mzansigo.co.za so that the money reflects in our bank account before the move. Your name/company name must be used as the payment reference. You may not withhold any payment for any reason whatsoever and may not apply set off.

You agree to make all payments to MzansiGo by one of the above means on not to pay any cash to any driver whatsoever. All outstanding amounts must be settled prior to offloading. If this is not the case, goods will be taken to storage and redelivered at your cost. You hereby give us the right to sell your goods to cover the costs of the move and storage should all invoices not be settled within 1 month. Any delays of payment more than 30 minutes at offload will result in additional charges being levied against the card details submitted. The amount charged is based on the information supplied by you and will be adjusted under the following circumstances:

- Goods do not fit into the cargo area of a Hyundai H100 or a Kia K2700 truck and an additional trip is needed. An additional trip must be requested via the web page. The same truck will then be allocated for the additional items.
- Goods do not fit in the lift, stairs or doorway, or if the road approach and parking is not suitable for our vehicles.
- You request special services – for example packaging
- There are any delays beyond our control
- More than two men are required to carry and load your goods
- If we are misinformed, by yourself, regarding access limitations and restrictions, we reserve the right to postpone your delivery to a time and date logistically executable.
- If there are any delays caused by yourselves, regarding access limitations and restrictions, we reserve the right to postpone your delivery to a time and date logistically executable.
- If we are misinformed regarding closing times of security gates and this causes our vehicles to be delayed.

Canceling a Request

If you need to cancel a move, please cancel the move as soon as possible in order to notify the mover of the cancellation. In the event that you cancel a move less the 12 hours from the first hour of the time window, you may be required to pay a cancellation fee up to 100% of the service fee. The total service fee less 20% (admin fee) will be refunded to the user should a cancellation take place prior to 12 hours of the move.

In the instance where the MzansiGo attempts to fulfill the Request but cannot do so for reasons out of our control, your credit card will be charged 50% of the applicable Services Fee.

MzansiGo reserves the right to cancel your move at our discretion.

All cancellations must be confirmed via the user "Move History" or by email sent to our consultants.

Arrival Times for Local Moves

All arrival times are estimate times of arrival and may vary between two to three hours before or after the estimate times allocated. We will not be responsible for any loss due to the late arrival of our trucks. We will however, to the best of our ability, try and keep to the given time of arrival.

Delays in Transit



If through no fault of our own, we are unable to deliver your consignment, we will move the consignment into our storage facility at which time the contract will then be fulfilled and any additional services including storage and delivery will be charged to your account. Should any time restrictions (e.g. closing hours at storage facilities, offices, etc.) at both the loading or offloading addresses, cause any delays to our team an hourly waiting rate of R250.00 per hour delayed, will be levied against you.

Ownership of Goods

By entering into this contract you declare that all the goods to be removed are your property. Or you have the authority of the owner of the property to enter into this contract in respect of the goods to be removed or stored.

Default

In the event of you signing this contract as an agent of a company or corporate body not paying our charges, you will be jointly and severely liable for payment of this contract.

In the event of any payment due to us not being paid on the due date, we reserve the right to levy interest at the maximum amount allowed in law, and if court action is instituted we will be entitled to payment of legal costs on an attorney and own client scale inclusive of collections and commissions. •

The parties consent to jurisdiction of the magistrate court but we reserve the right to institute actions in the High Court of South Africa.

Complaints Procedure
If there is any complaint that arise during the move you should immediately contact the following person to have the problem resolved immediately: - Thinus: admin@mzansigo.co.za
Poorly Engineered, Manufactured and Inferior Products with or Without Latent Defects MzansiGo accepts absolutely no liability whatsoever for damages resulting from poorly engineered, manufactured or inferior products. MzansiGo accepts absolutely no liability whatsoever for damages to items with latent defects. For any action you will be non-suited if you were:
- Careless in the non-avoidance of any damage;
- Any part of the damage sustained was due to your own negligence.
Work Excluded from our Quotation That Has to Be Performed by The Client
- Connection and disconnection of any electrical, electronic or plumbing equipment.
- Dismantling and reassembling of any furniture unless agreed so in writing.
- Removing and reinstalling of any doors, security gates or windows for the purpose of moving any item out of or into the property.
- Moving of any items that require more than four men to move it or any specialized equipment

Excluded Items

All of the following items are excluded from this contract. If moved by us we do not accept any responsibility for any loss or damages:
- Loose and unpacked items.
- Badly packed and unsealed cartons packed by the customer, Boxes exceeding 420mm x 420mm x 480mm in size.
- Owner packed boxes in a poor condition.
- Items of furniture not properly and professionally wrapped by MzansiGo.
- Valuable items: Jewelry, Cellphones, Computer Tablets, Laptops, Money, Trinkets, Deeds, Security stamps, Share Certificates, Sculptures, Paintings, Cycads, Firearms, or any similar items or collections.
- Any potential dangerous, damaging or explosive items may be destroyed or thrown away by us without your permission or prior knowledge.
- NO pot plants allowed to be moved by MzansiGo.
- Potential Hazardous items to our vehicles or other goods loaded.
- MzansiGo dissociates itself from any items given/sold to any member of our staff.
- It is agreed between the parties that only the items listed on the inventory is part of the move.
- Where the owner pre-packs his boxes we do not guarantee the safety of goods or quality of boxes.
Should any of this work be done by our staff, we will not be liable for any loss or damage.

Customer Responsibility

- All small items to be moved must be packed into boxes or bags before our team arrives. Packing costs will apply if we are required to do this work.
- Customers must not leave any valuables lying around including cell phones, wallets and sunglasses. We will not be liable for the loss of these items.
- You must inspect the premises and truck before departure to ensure all goods have been moved and nothing is left in the vehicle.
- All electronic equipment, Hi-Fi's, screens etc. must be boxed or crated. No unpacked / loose items or black bags will be loaded.
- All owner packed boxes must be of good quality.
- All owner packed boxes must be packed, sealed and ready for loading prior to our trucks arrival
- To notify us and properly identify any high value items (antiques, artworks etc.) to be moved, packed or stored at least 7 days prior to the move in writing.
- Ensure that all items are loaded and offloaded and not taken away or forgotten by error. You must inspect the whole truck prior to departure for left behind goods
- Be responsible for the security of your goods at the loading and offloading addresses and be present yourself.
- You, or your representative, are responsible for the security of your goods at pick up and delivery points.
- You must arrange for parking and/or any necessary cooperation and compliance with your body corporate.
- Two men must be able to carry and lift all items unless otherwise specified by you in writing.
- You may not defer payment to us or off set any amount due to us in the event of a claim or dispute
- MzansiGo will not be liable for any loss of income relating to damage/loss to/of any item caused by negligence or not.
- Properly preparing all appliances and equipment before it is moved. - Securing all your valuables such as wallets, cellphones, computer tablets, laptops, money, jewelry, handbags, firearms etc. These items will not be transported by MzansiGo
- All furniture, electronic, electrical and plumbing appliances must be disconnected and dismantled Page 3 of 4 prior to our trucks arrival. If this is not done we will not wait.

We are not liable for any loss, damage or additional charges because of anything listed in this clause.

Your Information

Your information may be used only to provide better service for you. You also agree that by using the MzansiGo platform, you have opted into our customer communications and may receive emails, text messages, or push notifications from MzansiGo. You may unsubscribe from these communications at any time by emailing us at admin@mzansigo.co.za.

Damage Policy

Please be aware that moving and storing household items is risky.

MzansiGo is not responsible for the condition or safe delivery of any your items moved. You are encouraged to make your own insurance arrangements prior to moving your goods with MzansiGo.

Neither us, staff members or subcontractors will in any way be held responsible for damages of any kind. We will however, to the best of our ability, try and move all your items safely and damage free.

Indemnification



You will defend us from and against any actual or threatened suits, actions, proceedings (at law or in equity), and claims, and indemnify us for any and all damages, payments, deficiencies, fines, judgments, settlements, liabilities, losses, costs, and expenses (including reasonable attorneys' fees, costs, penalties, interest, and disbursements) arising from or related to any of your conduct with respect to the MzansiGo platform or your violation (or alleged violation) of these Terms or the rights of any third party by you or any person using your MzansiGo account. Disputes between You and the Driver/Helpers

The MzansiGo platform is merely a neutral means of connecting you with Huyndai H100 and Kia K2700 trucks and helpers. We do not represent or warrant that any truck, driver or helper will meet your expectations or instructions in performing any Services. Any dispute that you may have regarding the performance of any Services, including any dispute related to the time, place, and manner of doing so, is between you and the applicable driver/helper. MzansiGo is not responsible for the replacement or repair of any of your personal property that may be damaged by a driver or helper while performing the Services.

Additional Terms

- This agreement constitutes the sole agreement between us & you unless altered & signed by both parties in writing.
- You hereby give us the consent to enter & handle the goods in the premises at your own risk.
- Due to unforeseen events, strikes, breakdowns, delays, etc. you agree to indemnify us against any claims.
- You must inspect vehicle post offloading for goods which might have stayed behind.
- Claims against us by third parties (people other than you or us). You shall pay any charges, expenses, damages or penalties including parking fines claimed against us in respect of your removal.
- We reserve the right to employ sub-contractors who shall be solely responsible for the removal if employed.
- We reserve the right to cancel your removal at anytime due to non compliance with our Terms and conditions.

General



Enforcement of these Terms is solely at MzansiGo discretion. Failure to enforce any part of these Terms in some instances does not constitute a waiver of our right to enforce the same or other part of these Terms in other instances. If any provision of these Terms is or becomes unlawful, void or otherwise unenforceable (including the warranty disclaimers and liability limitations above), then that provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the remaining provisions of these Terms will continue in full force and effect. The section headings of these Terms are for reference purposes only and will not affect the meaning or interpretation of these Terms.

These Terms (and the other policies and terms referred to above) make up the entire agreement between you and us regarding the MzansiGo Platform and the Services, and they supersede any prior agreements that may have been made.
